These Terms of Service (“Terms”) govern your use of symptomkeep.com, app.symptomkeep.com, and the browser-based Symptom Keep service (collectively, the “Service”) provided by Symptom Keep LLC (“Symptom Keep,” “we,” “us,” or “our”).
By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. What Symptom Keep provides
Symptom Keep is a consumer record-keeping tool that lets you record symptoms, review information you entered, and create summaries you may choose to share.
The Service is currently offered as an Early Access browser-based web app. Features may change as we learn from users and improve the product.
2. Not medical advice or emergency care
Symptom Keep does not provide medical advice, diagnosis, treatment, monitoring, or emergency services. Charts, trends, prompts, reports, and other outputs are based on information you enter and may be incomplete or inaccurate.
Do not rely on the Service to decide whether to seek care, change treatment, take medication, or ignore a symptom. Always consult a qualified health professional about medical questions.
If you believe you may be experiencing a medical emergency, call 911 or your local emergency number immediately. Do not use Symptom Keep to request emergency help.
3. Eligibility
You must be at least 18 years old and legally able to enter into these Terms to use the Service. By using the Service, you represent that you meet these requirements.
4. Your account
You are responsible for:
- Providing accurate account information
- Keeping your sign-in credentials confidential
- Protecting access to your browser and device
- All activity performed through your account
- Promptly notifying us if you suspect unauthorized access
You may not share an account in a way that compromises another person’s privacy or security.
5. Browser-local storage and no cloud backup
Symptom check-ins are encrypted and stored in the browser on the device where you record them. They are not automatically uploaded to our servers or synchronized across browsers or devices.
Signing in somewhere else may show an empty symptom history. An account-level encryption key does not recreate check-ins after the browser-local records have been erased.
Your symptom history may be permanently lost if you clear browser data, use private browsing, switch browsers or devices, reset or lose the device, use the clear-storage feature, or if the browser or operating system reclaims local storage.
You are responsible for exporting or sharing information you need to preserve. Symptom Keep is not responsible for browser-local information that is erased, corrupted, or otherwise unavailable.
6. Voice transcription
The microphone feature relies on your browser’s Web Speech API. Depending on your browser, device, and settings, audio may be processed by Google, Apple, Microsoft, or another provider.
Voice transcription may be unavailable or inaccurate. Review transcribed text before saving or sharing it. You may always type instead.
7. Sharing information
You control whether and how to share a symptom report. Before copying, emailing, or otherwise sending a report, confirm that the contents and recipient are correct.
Once you share information with another person or service, Symptom Keep cannot control how that recipient stores, uses, or rediscloses it.
8. Acceptable use
You agree not to:
- Use the Service unlawfully or to harm, threaten, harass, exploit, or impersonate another person
- Access or use another person’s account or information without permission
- Attempt to defeat encryption, authentication, rate limits, or other security controls
- Probe, scan, or test the vulnerability of the Service without written authorization
- Introduce malware, destructive code, or excessive automated traffic
- Scrape, copy, reverse engineer, or reproduce the Service except where applicable law expressly permits it
- Use the Service to build or train a competing product without written permission
- Upload or share content that infringes another person’s rights
- Misrepresent Symptom Keep outputs as medical advice or professional conclusions
We may investigate misuse and suspend or terminate access when reasonably necessary to protect users, the Service, or others.
9. Your content
You retain ownership of information and content you enter into the Service.
You give Symptom Keep a limited license to process information that reaches our systems only as necessary to operate, secure, support, and improve the Service, comply with law, and enforce these Terms. This license does not give us ownership of your symptom history.
Do not submit content you do not have the right to use or share.
10. Feedback
If you send suggestions, ratings, or other feedback, you allow us to use it without restriction or compensation to improve and promote the Service. We will not publicly identify you with feedback without permission.
11. Symptom Keep’s intellectual property
The Service—including its software, design, branding, text, graphics, and other materials—is owned by Symptom Keep or its licensors and is protected by intellectual-property law.
Subject to these Terms, we grant you a limited, personal, nonexclusive, nontransferable, revocable license to use the Service for your own noncommercial purposes.
No other rights are granted.
12. Third-party services
The Service relies on third-party providers for functions such as hosting, authentication, analytics, and browser-powered transcription. Third-party services are governed by their own terms and privacy practices.
We are not responsible for third-party services that we do not control.
13. Early Access and changes to the Service
The Service is provided during Early Access and may contain errors, interruptions, incomplete features, or material changes.
We may add, modify, suspend, or discontinue features at any time. We do not promise that a particular feature, browser, device, native application, storage method, or free offering will remain available.
If paid features are introduced, we will present the price and any additional terms before charging you.
14. Privacy
Our Privacy Policy explains how information is handled and is incorporated into these Terms. Please read it before using the Service.
15. Suspension and termination
You may stop using the Service at any time. To request account closure, email hello@symptomkeep.com.
We may suspend or terminate access if you violate these Terms, create risk or legal exposure, misuse the Service, or if maintaining the Service is no longer practical.
Closing an account does not automatically erase symptom check-ins stored in your browser. Use the clear-storage feature or clear the site’s browser data to erase local records.
Sections that by their nature should survive termination—including ownership, disclaimers, limitations of liability, and dispute provisions—will survive.
16. Disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, noninfringement, availability, security, or that data will not be lost.
We do not warrant that the Service will be uninterrupted, error-free, or compatible with every browser or device, or that any chart, trend, transcription, report, or other output will be complete or accurate.
Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.
17. Limitation of liability
To the fullest extent permitted by law, Symptom Keep and its owners, officers, employees, contractors, affiliates, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of data, use, profits, goodwill, or opportunities; medical decisions; or the conduct of third parties arising from or related to the Service.
To the fullest extent permitted by law, Symptom Keep’s total liability for all claims arising from or related to the Service will not exceed the greater of (a) the amount you paid Symptom Keep during the 12 months before the event giving rise to the claim or (b) US $100.
These limitations do not apply where prohibited by law.
18. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Symptom Keep and its owners, officers, employees, contractors, and affiliates from claims, liabilities, damages, losses, and expenses—including reasonable legal fees—arising from your unlawful misuse of the Service, your violation of these Terms, or your violation of another person’s rights.
19. Governing law and venue
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
Any dispute that is not resolved informally will be brought in the state or federal courts located in Travis County, Texas, and you and Symptom Keep consent to the jurisdiction of those courts.
Nothing in these Terms limits consumer rights that cannot be waived under applicable law.
20. Changes to these Terms
We may update these Terms as the Service changes. We will post the updated version with a new “Last updated” date. If a change is material, we will provide additional notice when required.
Your continued use of the Service after updated Terms take effect means you accept them. If you do not agree to an update, stop using the Service.
21. General terms
These Terms and the Privacy Policy are the entire agreement between you and Symptom Keep concerning the Service.
If a provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent. We may transfer them as part of a merger, financing, reorganization, sale of assets, or similar transaction.
